The following are the terms and conditions you must be aware of:
This is an agreement between you and greatlance.com. We request you to read the terms and conditions stated in this User Agreement carefully before you start using the site,viz. www.greatlance.com.
All the terms and conditions given in this User Agreement and other conditions given as reference constitute the entire agreement between you and Greatlance.
If you do not agree to any of these terms and conditions, please stop using this site. If you are found to be indulged
in the activities that are violating this User Agreement, we may close, suspend or limit your access to our Greatlance.com Site and/or our services to you.
Greatlance has the full privilege to revise a part or whole of this User Agreement at any time, without any prior notice. And, the new Agreement will be effective from the time we post it on our site.
The individuals or business entities who have capacity to enter into agreements that are enforceable by law are eligible to use this site. However, acceptance of a person as a customer of Greatlance is purely at the option of Greatlance and Greatlance can remove the access through/to Greatlance by an account at any time, if found to be violating the eligibility criteria. It is the responsibility of each user to monitor what happens in their account and report to us of any unauthorized usage of their contents/data.
Greatlance.com provides an online platform for the users. There are mainly two types of users,
Freelancers or Service Providers (referred as “Seller” or “Sellers”) who wish to provide services (those who wish to work) and Hirers or Service Buyers (referred as “Buyer” or “Buyers”) who wish to seek services (those who wish to get the work done). This site provides platform for the service buyers and service providers to identify and communicate with each other, work or get the work done, invoice /pay for the work done/ being done, and to rate each other based on the work done.
Greatlance.com reserves full rights to close the account of any user who violates the User Agreement, without offering any reason or prior notice. Our Site has given privilege for any user to report against any other user for violating any of the policies and terms of the User Agreement, creating problems, involving in illegal or immoral activities and for other such reasons. Greatlance.com will immediately terminate such accounts from using our Site.
The relationship between the users is based on the project they are involved in. A Buyer selects one or more Sellers for his/her/their project. Soon after the Seller’s acceptance part of the project, the Project starts and the Buyer is deemed to have agreed to purchase the services from the Seller in accordance with the following agreements:
(1) User Agreement
(2) Service Agreement to be signed by the Buyer and Seller
(3) Any contractual provisions accepted by both Seller and Buyer uploaded on this site which is consistent with the User Agreement.
Both the Buyer and the Seller are deemed to have agreed not to enter into any contract that are inconsistent or violating the policies of User Agreement.
This User Agreement does not create any partnership, joint venture, agency or employment relationship between the users as well as between the users and Greatlance.com. Hereby, each user agrees and acknowledges that the relationship between users is that of independent contractors only.
The Services Agreement has clearly stated the responsibilities of the Buyer and the Seller. When a Buyer or Seller enters into a transaction (which is not prohibited by law or by this User Agreement) with other users of the site, he/she creates a legally binding contract with the other user. Every user of this site is responsible for the obligations that he/she made to other users and become liable to the users, if he/she violates it. Also,
users need to be aware of the domestic laws, international laws, statutes, ordinances and regulations relevant to him/her as a Buyer or Seller.
Greatlance.com has no responsibility for enforcing any user rights. If a user violates any of the obligations made to other user, the users involved are responsible to solve the issue by enforcing any rights they have.
Greatlance.com provides just an online platform for the users to buy and sell services and is not involved in any other transactions between the Buyers and Sellers. Hence, Greatlance.com does not offer any form of insurance or protection to its users. However, Paypal and other forms of payments allowed in this site give limited protection or chargeback services to the users and the users must be aware of these before doing any transactions through this site.
There are two ways of verification- Phone Verification and Address Verification being performed by Greatlance.com after the Email Verification which is basically done soon after the registration. Users can verify their phone and address through the link in Greatlance.com and become “Secured Users” (those users displayed with
a special symbol). Yet, the users are not 100% secured. The phone and address alone are verified and found not fake but, Greatlance.com cannot assure that the phone and the address verified belong to that particular user. Hence, user identification on the internet is difficult and Greatlance.com does not confirm any user’s identity.
Greatlance.com offers a wide variety of services, benefits, content, products and other resources on the site to its users and enables them to cost effectively and extensively make use of these services to manage their careers, businesses and professions. But Users don’t have the right to sell or copy the services or content, to exploit the access or use of this service in any way.
The services mainly include the response provided by our Support Team for the various queries of the users and some articles about the site and its activities. There is no warranty that these contents are accurate and up to date. None of the Greatlance.com members are responsible for the loss or damage (either direct or indirect) that is caused by the users relying on anything contained in the contents of the site.
The following terms are deemed to be agreed to by the User:
As already stated, Greatlance.com provides an online platform for the users to buy and sell services and hence, every user acknowledges that Greatlance.com is not involved in any of the transaction between the Buyer and the Seller and has no control over the quality of services provided by the Seller or the payment made by the Buyer. Greatlance does not guarantee that the user will actually complete a transaction agreed to or act accordance with the law in using our site.
There are various contents being posted in Greatlance’s site on various subjects such as legal, financial, health and other matters but the contents are only informational for general and non-advisory purposes and are not to be considered to be professional in medical, legal, technical or any other discipline-specific advice. If desired, users should put in their own efforts to confirm such information by professionals in the relevant fields.
Since the website is dynamic and the information being changed frequently, it is possible that some information could be considered inaccurate, harmful or irrelevant to the subject that may be posted accidentally by Greatlance.com or purposefully by any third party, with or without a legitimate business purpose.
Greatlance.com does not monitor any access to third party content. Therefore, any links to third party websites and the contents posted by any third parties, though legitimate under the copyright laws or any other similar laws, are not monitored by Greatlance.com and users should not treat any link as acceptance of veracity or an endorsement. We don’t maintain resources to control, verify and validate the content which we receive or viewed on our site.
Greatlance.com earns fees as set forth in the Summary of Greatlance.com’s Fees and Charges which can be found on the site. All fees for transactions made are expressed in US dollars unless otherwise specified.
Greatlance.com charges no fees in relation to posting of project. But for featured project, for Users who wish to become Premium Users (Membership Activation and Renewal), for a Seller to be selected for a Project as Bid Winner, Greatlance.com charges an appropriate amount as fees.
Greatlance.com provides its users with “Escrow Service” in which Greatlance.com accepts funds from Buyer which he sends it for a particular project to a Bid Winner of that project on a full time or part time payment basis. Greatlance.com holds the funds until the Buyer and Seller agrees on the amount and the Buyer consents to release of funds to the Seller or when the dispute has been resolved, if any.
If a user does not give consent for release of funds that Greatlance.com holds for him/her on a particular project within 1 year, then the funds will be refunded back to the Buyer’s account. All transactions under escrow are stated and handled in US Currency ($) only.
You must register for an "Account" to become a user of Greatlance.com and to access our site and its services. By this registration you, the users, agree to provide accurate and true information about you as prompted in the Registration form and all other forms you access on this site. It is also recommended that you update this information periodically as when and needed to maintain accuracy and completeness.
Greatlance.com will not provide any interest or other earnings on the funds which it handles as your contractor, though it may receive any interest on those funds. All payments and transactions are made in US dollars only.
We reserve the rights to suspend a withdrawal from an account which is found to be fraudulent. Greatlance.com are entitled to enforce return of funds by a user or effect account termination or take any other measure to recover the funds if a withdrawal has already been processed in a fraudulent payment situation. And, the user removed from the service due to violation of this User Agreement will not receive any credit or payment and will be liable for certain fees/charges described in this User Agreement.
Every user acknowledges that:
1. Greatlance.com does not provide any banking services since it’s just an online platform for the users to buy and sell services.
2. Greatlance.com is acting only as an agent with respect to the funds and payments made for a project and is not a trustee
A user account with nil or negative balance for more than 1 year shall be considered as an “Inactive Account” and shall be canceled by Greatlance.com at any time without prior notice.
Grealance.com is not liable for any chargebacks on funds that are paid to you (the sellers) by the Buyers through the site and it’s your responsibility to bear such chargebacks. Greatlance.com may reverse any such payments that are subject to chargeback via our payment processors. Hence, to cover the cost of processing chargebacks, we can access funds of users towards such processing fee.
Greatlance.com has the rights to collect any funds owing to Grealance.com by any legal means if there are not sufficient funds in your user account to meet the outstanding fees and charges.
You are responsible for paying any taxes, including any goods and services or value added taxes, which may be applicable depending on the jurisdiction of the services provided by Greatlance.com. These taxes will be added to
invoice billed to you, if applicable.
Please note Australian customers are required to pay an extra 10% goods and services tax on all fees.
Greatlance.com strictly prohibits the following activities between the buyer and seller for a project:
1. Attempting to negotiate the fee for a project with another user directly when the project is ongoing in Greatlance.com.
2. Both Buyer and Seller are responsible for notifying to Greatlance.com about the increase in payment. This can be done via increasing the Bid for the project in the “Edit Bid” page.
3. Under bidding on the projects thereby negotiating the actual payment privately in order to avoid fees.
Greatlance.com automatically provides the Email Address of the Buyer to a Seller, soon after the Buyer selects the Seller for his/her project. Hence, there is no need for the users to give their Email Addresses at anywhere in the site, provided they have given the Email Address while registering in Greatlance.com. Also, no other methods of communication like phone, ICQ, AIM, AON, GTalk, Yahoo, etc are allowed. Users can make use of the “Private Message Board” service to communicate with each other on a project, once the Buyer has chosen a Service Provider for a project. Also, users are prohibited to either provide their contact information (address as well as phone number or any other contact information) to any other user nor contact other users outside of this site since there are “Message Boards” to communicate about the project they are involved in.
Read the following instructions carefully before providing any information in Greatlance.com, since you are responsible for whatever content you post in the site:
Remember that Greatlance.com is an online platform for users and so it provides no warranty to the user on published content. Also, if content is found to be inappropriate, creating harm for our business operation, or cause Greatlance.com to lose its customers or cause any other loss of similar kind, Greatlance.com has full rights to take any action on the user who has posted such content.
Each user should be aware and acknowledge the following regarding the content they post on the site:
a. It will not violate any copyright, patent, trademark, trade secret, intellectual property right, proprietary right, or right of publicity or privacy.
b. It will not infringe upon any law or regulation and will not be offensive.
c. It will not include any incomplete, inappropriate or false information about any users of this site or any other individual.
d. It will not contain any viruses or computer programs that may damage or intercept any system, data, site information or any personal information.
Also note that no copyright messages can be posted on this site, but excerpts of scripts, as examples or some sections can be posted provided the content is not exceeding 10% of the original contents. This is mainly to provide the intellectual property rights of the authors.
Greatlance.com strictly prohibits users from advertising a website on this site. Only URLs related to a project on Greatlance.com (for example, user’s portfolio, resume page, etc) are allowed to be posted in project description, message board or in bid description.
While placing bids, the Sellers must be aware that it is the total amount of money they are requesting for the project and is not any hourly bid or any other inappropriate type of bid. The Buyers in turn must be aware that they create projects in such a way that they require Sellers to place only for total money and not for any hourly basis or any other similar kinds of bids.
The following terms are applicable to and are agreed by the Buyer (Service Buyers):
Redistribution of any of the content from the site (includes but not limited to private messages, documents, etc) are strictly prohibited.
Using the Greatlance.com account for posting any false or misleading project descriptions are not allowed.
Posting project descriptions or contents that are irrelevant, inappropriate to Greatlance.com’s viewers, customers, etc may result in suspension of the account.
By posting a project as “Featured Project”, the Buyer agrees to pay the featured project fee.
By posting a project as “Pre-Paid Status Project”, the Buyer agrees to pay the pre paid status project fee.
The Buyer is prohibited from providing false information about him or any other users.
All the policies being posted on the site at anytime are agreed and abided by the Buyer.
The following terms are applicable to and are agreed by the Seller (Service Providers):
Redistribution of any of the content from the site (includes but not limited to private messages, documents, etc) are strictly prohibited.
Using the Greatlance.com account for posting any false or misleading project descriptions are not allowed.
All the policies being posted on the site at anytime are agreed and abided by the Seller.
Every user agrees and acknowledges that:
Using any manual process or automated collection mechanism to monitor or copy the site’s web pages with the contents of Greatlance.com without prior written permission from Greatlance.com are strictly considered to be illegal.
Distribution of spam messages through the user’s account is prohibited.
Contacting Service Buyers or Service Sellers through the information gained from the site with the intent of undermining them from using our Services is strictly banned.
Users are not allowed to engage in personal attacks or any unprofessional online conduct or practices.
Creating multiple user accounts thereby avoiding fees, suspension or bad ratings are strictly not allowed. If found, Greatlance.com has the full rights to take necessary action on the user.
In case of termination from Greatlance.com, users would not receive any credit or payment from Greatlance.com provided they have violated the User Agreement. Users should pay all fees owed to Greatlance.com and reimburse us for all losses, costs and other reasonable expenses, if any.
Greatlance.com provides Dispute Resolution Service for those registered users who use the “Escrow” mode of payment. You agree and acknowledge that:
Greatlance.com neither provides any legal service nor advice users regarding legal matters. If you need to have a legal counsel, you will have to seek one independently and not rely on Greatlance.com for any such counsel. If there is any dispute between the Buyer and Seller regarding the release / return of Escrow payments, either the Buyer or the Seller can make use of the “Dispute Resolution Services” of Greatlance.com and raise a dispute against the other user thereby notifying us about the dispute being raised and Greatlance.com will notify both Buyer and Seller that the matter will be addressed through our Dispute Resolution Services.
Users agree that they will post reasonable and fair demands / offers and will resolve the dispute peacefully under the monitoring by Greatlance.com
Our dispute resolution services are applied only to the Escrow Payments with amount equal to or more than $30 only.
Round -1:- Resolution among themselves:
Round-1 is the mutual resolution Process in which Greatlance.com allows the Buyer and Seller to resolve the dispute among them.
Each party will have 7 days time from the start date of Dispute within which both Buyer and Seller should resolve the dispute among themselves. They can post their offers/demands in the Dispute Discussion page (users can demand/offer the % of amount under dispute i.e., between 0% and 100% of the total amount which is counted in dispute). Please note that the sum of all the funds which have been escrowed to the Seller but have not been released by the Buyer will be counted for the Dispute. One can either accept or reject the offer/demand made by the other party. If the user is not satisfied with the offer/demand made by the other user on a Dispute, then the user can reject the offer/demand and enter his demand/offer respectively. This process continues for 7 days time until either of the users accepts on the other user’s offer/demand. Once accepted, the dispute is resolved and the offered/demanded amount will be transferred accordingly.
Round-2:- Resolution by Greatlance.com
Round-2 is the next stage of the dispute resolution process when the dispute has not been resolved within the 7 days.
When neither the buyer nor the seller accepted the demand/offer and resolved the dispute among disputes, the dispute is handed over to Greatlance.com automatically on the 8th day after which Greatlance.com will review the discussion being made by both the parties and settle the dispute in a fair manner. It takes up to 7 days for Greatlance.com to settle the dispute during which both the parties can submit documents (if any) for proof regarding the Dispute in the “Proof For Submission” page which is enabled once the dispute goes into the hands of Greatlance.com. We will review the dispute discussion being made by both the parties and the documents submitted after which we will settle the dispute.
Greatlance.com’s involvement in disputes is only to settle the dispute in a reasonable manner by reviewing the discussion and the documents from both buyer and seller and in no way Greatlance.com will be involved in any transactions between the parties of the disputes. In no way, Greatlance.com is connected to either of the parties involved in the dispute. Greatlance.com is not responsible for any of the transactions, claims, demands and damages that have occurred related to the dispute.
Your personal information will be processed by Greatlance.com in order to fulfil the agreement with you, perform delivery of products etc. Furthermore, we will process your personal information for marketing of campaigns, offers, new products or services. Your personal information may also be transferred between Greatlance.com and any associated entity within the Greatlance.com organization. At such transfer, personal data may be transferred outside
Greatlance's private area. By entering into this agreement, You hereby approve such processing of your personal information as set forth above, including processing of your personal identification number, and hereby give such consent as required by the Swedish Personal Data Protection Act (Sw. personuppgiftslagen 1998:204). The consent hereby given can in whole or in part be recalled by giving written notice to us. Should you choose to recall your consent, and such recall should make our due performance of the agreement or other obligations difficult, we reserve the right to immediately terminate the agreement. Greatlance.com discloses sensitive personal information only if required to comply with legal obligations or with your consent.
All the contents incorporated on the Site (such as text, graphics, logos, icons, audio clips, images, downloads and software, articles, etc) are the property of Greatlance.com and are protected by Indian and International Copyright laws.
It is our policy to respond to clear notices of alleged copyright infringement. Our policy, set out below, is designed to make submitting notices of alleged infringement to us as straightforward as possible while reducing the number of notices that we receive that are fraudulent or difficult to understand or verify.
The Digital Millennium Copyright Act 1998, found at 17 U.S.C. 512 ("DMCA"), provides recourse for owners of copyrighted materials who believe that their rights under United States copyright law have been infringed upon on the Internet.
Under the DMCA, the bona fide owner of copyrighted materials who has in good faith believe that their copyright has been infringed may contact not only the person or entity infringing on their copyright, but may also contact the designated agent of an Internet service provider to report alleged infringements of their protected works, when such alleged infringements appear on pages contained within the system of the Internet service provider ("ISP").
As the owner of the Site, we are committed to complying with the DMCA. Upon receipt of a properly filed complaint under the DMCA, we will block access to the allegedly infringing material. We will forward a copy of the notification of claimed copyright infringement to the alleged infringer. Anyone who believes in good faith that a notice of copyright infringement has wrongfully been filed against them, may submit a notice as set out below.
Greatlance.com has a limit on the Buyers to post projects. A normal member is allowed to post 20 projects at the maximum whereas a Premium Member can post up to 30 projects. Also, Buyers must have enough funds in their account before posting any featured or pre-paid status projects which involves fees.
In case of Bidding for a Project, normal sellers have a limit of 20 bids whereas for a Premium Seller, its 25.
The terms and policies of this User Agreement are severable, and if any policy of this Agreement is found to be invalid or non implementable, such policy may be excluded and the remaining policies will be implemented.
